I think I know the answer to this question I am about to state but want to make sure if anyone is familar with this situation.
My wife has been in America for almost 3 years and will have the conditions on her permanent status lifted any day now. She brought her 15 year old son but left behind at daughter which was 20 at the time. She had good reason. She just graduated from law school and expected a good job. Well after the Russian goverment found out her mother was living in America it has been almost impossible for her to get a job that she spent 5 years going to school for. Now she wants to come to America. She is 23 now, no children and never been married. From what I have read if she was 20 years old it would be no problem. Does anyone know if I have missed something, otherwise I think she goes into the lottery and has a slim chance in 2010 since the lottery for 2009 is closed.
Bob, To the best of my knowledge the children can come to the US "if" they were listed on the mothers fiance visa as her dependent child, under the age of 21 and never been married at the time the fiance visa was applied for.
