When one is illegal and marries to a US citizen, he is deported, but he is given a chance to come back by filing papers legally. This is not what you are talking about. Your example is he got a tourist visa legally.

When you APPLY for a Tourist Visa you are asked (among many things) if you are intending to get married or have any intent other than those for which the Visa is specifically intended. If you LIE under the conditions stated above and you ARE planning to get married - its FRAUD.

But NOBODY is talking about "illegals" (meaning people who have come into the country illegally). That isn't even an issue that has been introduced. We are talking here about people who ARE here legally - but for a completely different reason - Tourism.
A Tourist Visa is a NONimmigrant visa. Its temporary. As your husband or wife - you must eventually apply for a "change of status" to an IMMIGRANT Visa - at that point questions will come up regarding the timing of your visa and your marriage and if they are suspiciously close you could be int trouble.

You talked about illegals. USCIS will not deport anyone who is legal. When they come to the country for a specified amount of time and they go past that time, they are illegal.

That may very well be because there is fraud going on, but it is not illegal for a tourist visa holder to get married.
Go back and read the WHOLE thread again. Sunvolt indroduced the subject as a means to avoid having to get married in Ukraine OR a fiance visa. Getting married FRAUDULENTLY on a Tourist Visa was the whole point of this discussion.
Did you see anybody introduce the subject of getting a Tourist Visa for the heck of it and then just getting married later? NO.
It was SPECIFICALLY being discussed as a way to avoid other TYPES of visas for Rick4girl to use to get MARRIED!

No matter how you look at it, getting deported is being illegal and you talked about it, then you deny it.
ragingbull: You need to try and fully undertand the question that is being asked and answered in a forum thread like this one. This one was written for a very specific reason. The issue was" Can a TOURIST VISA be substituted when one plans to get married?
That is the issue that we have been writing about. You can jump in the middle and pretend somebody is saying something like "You can never get married on a Tourist Visa." That wasn't the question OR the issue. The SUBSTITUTION question was. And I shouldn't need to repeat that with every post.

No matter how you look at it, your statement is wrong, and you are not willing to admit it. You will try all explanations possible, all which I answered except admitting it is another misleading statement by you.

I think the whole point of getting married in Ukraine was to apply for a K3 visa, as opposed to a K1 visa, because the K3 requires less time to be seperated from your spouse.
A chuch wedding will not satisfy the requirements of a K3 visa. "
It is quite clear to anyone not a liar, who reads it - that I am answering sunvolt and his contention that you can bring a girl over on a Tourist Visa and marry her.

How will the US know it is planned if you don't admit it?
From a lawyer. One immigration fraud constitutes a one year ban from entering the US. Two is a three year ban. Three is a ten year ban.
