Hi, I have a question maybe someone could answer for me before I call my former lawyer who handled our visa.
My lady was here already on a K1 visa (US). Unfortunatly we were never married and she went back, due to personal circumstances. I am assuming I have to go through this whole process again to get her back here. Maybe someone here has some knowledge about a situation like this? Thanks
Yes, you must go through the process again. I cannot speak about what effect the first K1 will have on her chances for another. You do not mention if you were the petitioner for the first visa or not. If you were not, she would not have been able to stay anyway. Yes, she was here for me. I'm just hoping it doesn't ruin our chances for another visa. She didn't overstay her 90 days, its just that it took this for us to realize we don't want to be without eachother. I'm sure were not the first couple to go through this. I was just wanting to know if anyone else has done this before. Thanks for the reply Ditto.
Supposedly it should have no effect on having previously applied of a K1, but everything I have read has applied to the man, not the woman. Since the approval is a very subjective process, who knows what effect it will have. Me personnally, I would be more impressed with the fact that she followed all the rules while here and actually a decision based on the relationship. It tells me she didn't just come here for the Green Card.
She definitly did not come here for the green card. She would be happy if I decided to uproot and move over there. I'm waiting to hear back from the lawyer who handled our visa. Waiting for the first visa was hell, waiting for another one is going to be even worse.
