Our family sponsored a high school student 2 years ago from Russia. We have tried to bring her back on visitor's visas and other student visas for 2 years, but no luck. Our son, who is now 19, going on 20 and soon to be a college student, wants to marry her. If he is a college student, is that possible? And, can we provide the financial support for them for the INS? They will live at our house until they get student housing on campus. Any ideas?
Momo I would say he needs to do a k1 visa. As they already met and you have proof of that it should not be a problem as long as it is not more than 2 years. If it is past that he may have to go to her forst and document the trip. You can sponser her if he does not meet the requirements.
Fiancee visa (K-1) won't work, unless he travels to meet her. The longer the wait between a meeting and application, more doubtful the relationship, and especially in this case, with all other student and visitor visa applications in between.
K-1 Visa will work if you can prove there was a relationship starting when she lived with you. Photos together etc. Current letters between the two will help.
The part that may cause a problem is proof of being able to support her at 125% of the poverty line in the USA. You may be able to get around this if you agree to be the sponsor. One catch though. Legally she would have to be supported at this level for 10 yrs from their marriage date, if things do not work out between them and she stays in this country.
