Hey vets! Are there any age-difference limits or restrictions for US men marrying FSU women? I was reading through some ancient posts and a couple of comments kind of threw me.

if there is an age gap of 20+ years...stop and think where this relationship might be in 10 or 20 years from now..food for thought...The 40 somethings i know do not want to go nightclubbing anywhere near as often as the 20 somethings i know...lol...to say nothing of music choice's and desire's with such a difference in age..and thats just one aspect to consider.

It's not so much about years but percentages.
If she is 19 and he is 39 then that is ridiculous, but if she is 50 and he is 70 then that's a different scenario but both will have a 20 years age difference.

Thanks guys! I was pretty much already aware of the "20+ year bust" and the "half your age + seven" rule. But there was an earlier post that mentioned difficulty with obtaining a fiance or marriage visa in the FSU when there was a significant age difference. My fault, I didn't make it clear.
Like Martin wrote...the common sense rule always prevails and the need to be even more sensical rises proportionately with the age gap.

A consulate may issue or indeed refuse a visa for many reasons. The lady that came to live with me on a fiancee visa some 5 years ago was, give or take a few months, half my age and her visa application went like clockwork ..... unfortunately :)
If I was a consul and a guy of 70 years old walked in with an 18 y/o beauty on his arm then, by my own personal opinion, I would refuse the visa but a 20ish year age difference by itself shouldn't make any difference, the consulate need to adjudicate if it is a genuine application or not.
"A visa can be refused ONLY upon a ground specifically set out in the law or implementing regulations." 22 CFR 40.6.
The are no legal age difference requirements. But again, the federal government isn't run on laws or regulations, but on discretion, simply because it has no higher authority to watch over it, and it won't police itself.
Sorry, but it just gets to me, when these intelligent folks sound so ignorant. What if they never got a high school diploma (county) because of an official's personal discretion, or a driver's license (state), or a business license (city). To suggest that there can exist something (visa), which has to be DESERVED, rather than QUALIFIED for is absurd.

Excuse me DrKoop but when I started out on this process back in 1998 in the relatively early days of the internet and without such forums as this or blacklists it really was 'explorer' days.
I didn't have anybody to ask thus naivity existed but despite my education you are suggesting that had I had the common sense to ask a question then I would be frowned upon for being ignorant.
Yes, in those days I did have a level of ignorance towards FSU etc. but that is no crime to admit to one's level of ignorance in an area that is new to them. Christopher Columbus was ignorant until he discovered it but I guess it is easier to criticise others whilst declining to accept that one person cannot possibly know everything :)
I plan on posting the US fiancee visa requirements, and I won't give you the FAM (light), CFR (medium) or INA (heavy) version, but the USC (extra heavy). If a consulate claims a different reason for visa denial, you'll know better.
What I'm finding is people who have genuine questions and are seeking REAL information from people who *may* have had a similar experience to guide them, specially when it deals with legal issues such as immigration. And instead, what we get is a bunch of people posting *their* opinion about something that has NOTHING to do with legalities, If you have not had a similar experience, then help the person by directing them to some websites for more information, but don't bring your personal opinion to a topic that has to do more with legal issues.
It seems like there are LOTS AND LOTS of marriages with "considerable" age difference (10, 15, 20 years) with the man being much older or the woman being much older. I feel sorry for those asking questions because if they bother getting into these forums, it means that they are in a bonafide relationship (I think it's fair to assume this) and would like their visa process to go smoothly and have plan B in place just in case. These are people who really care about getting married, despited the age difference.
Why bother these people with your personal opinions? Just because you think that a 50 yr old man cannot marry a 20 yr old woman? c'mon! It happens ALL THE TIME. The fact that the marriage might end in the future is ANOTHER STORY. Nevertheless, the bonafide intention to get married was there. The same thing happens if a 40 yr old woman wants to marry a 20 yr young man. The fact that the marriage *might end* in the future, that's one thing, but a fiance visa CANNOT be denied solely on the age difference. If the petitioner and fiance provide ALL the evidence that their relationship is bonafide (photos, trips together, phone calls, letters) and they bring all the documents, the consular officer has no other choice but to approve it - the visa is a "FIANCE VISA" - meaning that it's a visa to get married. If you can prove you will get married, then fine. If you don't get married once the fiance is in the USA, then the fiance needs to return to his/her country and if they don't, that's another legal issue between the fraudulent parties and the US government. And if they DO get married and 5 yrs down the road they get divorced, then that's a problem between the 2 of them and no one should care.

until you have gone to court and all appeals, , have been exhausted, from both sides

In NZ we dont have one, so you have to apply for a visitors visa.
The same rules for a visitors visa to the US, applies in NZ (you dont get one)
So the application can be thrown out on any whim, without redress.

ust returned from another trip to russia reading of age difference hmm i think it accounts for not much ive just celebrated 49 years my girl 26 and 4 months , we dont have a worry guys.
matter of fact we never seen it better !!!!!! man may as well go out in style , was a good trip took her all round russia.

I believe though as sweetheart said i think the russian draconian system registration all that sort of criteria - i dont think its enforced 1/2 as much as it was / or maybe should be .
