my fiancee wants to return to ukraine to visit her parents but she has overstayed her j1 visa. Anyone know if she can go to ukraine and come back? Any brainstorm ideas on how she can return? Fake visa? Use a similiar looking americans visa? Legal ways to return? Come back on a j1 program 3 months later? Any ideas would help
Fake visa? That sounds very, very scary. Maybe just get married, and wait for the dust to settle. I mean, wait another six months after she gets married. I'm sure other guys know bettr than I, but I recall hearng they have to wait two years before being allowed to leave (and return.) Be careful!

If she goes home, after overstaying a visa, make sure to say goodbye really really nicely before she goes, just in case it turns out to be many, many months before you ever see her in America again-- if ever.
NO JOKE. Even if she goes, then tries to get a J1 and gets denied, and you decide to K1 fiancée visa her, one of the most important questions on there is 'have you ever overstayed a visa.' (Then there is the question about 'have you ever been denied a visa'-- to which she will likley be responding 'yes' after having re-applied for a J1.

Hiii98- I would hate to say it but you both are in for a looooong uphill battle.
From my point of view- and I am not a lawyer - I think you both are screwed overstaying a visa. Consular officers are just looking for any excuse to deny a FSU woman a visa and overstaying is just what they need to see to tell your lady, "DENIED"
Plus IMHO, if you ever use a fake visa or a fraudulent american passport and you are caught - which chances are you probably will be. She will be banned from ever entering the US again and you just might be brought up on charges yourself.
Hire an immigration attorney, cross your fingers and hope for the best. Good Luck.
