alright my friend was married in Russia, and now their both living in the us, and both are us citizens(born in us) her man has come out and said hes been cheating and hes leaving her, and doesn't have to give her shit b/c they were married in Russia and never in the us??? they are 2 kids involved and a ton of money. any advise or direction on where to find some info would be great,
LOL!!! She just needs to remind him of the document he signed to support her if the relationship fails. Divorce is jurisdictional. It doesn't matter where you were married, it's the fact that your married. Guys that are venturing in this area of a foreign bride need to take into consideration is they are responsible for her support. We don't have alimony in Indiana, but with a foreign bride you are responsible for her support beyond child support to keep her off the public assistance. If he doesn't pay, they will attach his earnings to repay any public assistance she receives. Up to ten years if I remember correctly after the relationship fails.
Be wise gentleman, this isn't well if it doesn't work I can kick her to the curb and move on to the next one, more responsibility involved with a foreign wife.
P.S. It would also be wise to inform her attorney to contact an immigration attorney regarding the support aspects, some local attorneys are not aware of this and proceed on with normal divorce proceedings. Or advise him to look at the responsibilities of the native spouse in regards to immigration to the US>
It does not matter where the marriage took place, it matters where the divorce takes place. As long as the jurisdictional requirements are met, ie: lived in the particular state long enough, lived in the particular county long enough, jurisdiction will exist and the divorce will proceed the same as if they got married across the street. The guy saying because the marriage took place in Russia he owes nothing is in for a real surprise. This is not some exotic immigration law or issue, any lawyer who has done one divorce can give you this answer.
