Sometimes, there is a way of expunging a felon's record, depending on what he has done and how long it's been. That is, remove it from file. Go to the courthouse and ask about it. Other than that, I think he (you) need a lawyer.
XT: Your fiance will have to declare this on the I-129F form. He will have to have additional documentation regarding the type of crime and other information. Usually it is not a problem but he must be honest.
RB: As far as USCIS is concerned, there is no "expunging of one's record". It will always be there and must be declared.
XT: Go to the VisaJourney forum website for much more information on what to do.
Interesting, Baron. If one has a drunk driving conviction 25 years ago, it cannot be expunged for immigration purposes. I went to Visa Journey on your recommendation. Good info. I am sure I will need it.
Come to think of it, my dad had a K1 approved for a lady about two years before he died. Funny thing is she is two years younger than me. He also had a drunk driving conviction (a felony) five years before, and another one seven years before that. I don't know how he did it, but it must not be a big deal - a statement, a box checked, another form.
