I'm in the U.S. and I'm engaged to a Ukrainian woman with a small child. We are concerned that the ex-husband will try to delay the process by not giving permission for the child to leave. Been told going to court can take several years and big money. Is there anyone out there who has been through this in the past year? Would like to hear about your experience and how you handled it. FYI she has joint custody but the father has not seen the child since he was 6 mos. old. He is almost 4 now. There is some sort of monetary support taken by the court every month which comes to be around $15 she gets each month.
A good lawyer will solve that problem in a month. If the father isn't a big shot to influence the court. So find a good lawyer. Which city is she from?
I'm in a similar position, it has taken just over a year to sort out through the courts - you need a good lawyer and the total cost should be around $3,000. Do not pay or offer to pay the father cash - you need to get the correct paperwork or you will have even more problems when it comes to getting a visa for the child to leave the country. If you need any help please send me PM.
Do not offer to pay the father unless you also have all the other required paperwork
for him to sign and present to the court. Full payment should only be AFTER a successful
court approval.
A Lawyer is essential and will cost about $1500 for a simple case and can be done in a few
months from start to finish.
I had this problem 4 years ago with first lady I wanted to bring to USA. We didnt have a lawyer
and I didnt know the system very well and the ex husband won the case.
I read from here once that they can go after the husband if he is in arrears with support. Rick, I guess the marriage did not happen since you were not able to bring the kid?
yup, no marriage. they can go after fathers for arrears but it doesnt happen often and the amounts most pay
are pathetic. whats wierd is that she was my very first meeting after i split with wife. gave me all kinds of false expectations after that.
