About 3 months ago I met a Russian girl on the internet. We talk on skype everyday. I'm going to see her in December and I want to bring her here and marry her, maybe next summer. I know this is a difficult task and I need to start planning now. We are both 21 years old. I've looked into a K-1 visa. My only concern is the I-134 Form, Affidavit of financial support. I work for my parents real estate development company in which I make good money. I currently have $30,000 in my bank account. The only problem is that I am paid "under the table" and I will not be able to show a tax return. What are my options for this? Should I start filling taxes or is there something else I can do?
without a tax return you have no proof of income. filing (not filling) a tax return is the only way. plus you need three years of proof. I'd say you are too young myself. but, without a history there is little chance. do you have major medical? there is a lot more to it than having 30K in the bank. I suggest you invest a little more time in this woman. look at everything. scrutinize her motives etc. good luck
Others with the proper tax return and income can do the Affidavit of Support on behalf you and your girl. In other words, they will take on the responsibility should the girl be on government assistance in the next ten years. You can have more than one person do this.
Ralph is right. Years ago,,, you could use three forms of proof, Tax returns, bank statements, or proof of property. Back in 1998 you needed at least 12,000USD of “adjusted gross” income. Last year it was on line 21 of a reg tax return! That number has since went to 14,000 and now 16,000USD!
In 1998,,, just to be certain,,, I sent in all three forms of proof. Three years of tax returns, three months of bank statements, and a copy of my car titles, I might have even sent a photo of my beef herd?? Lol
I asked an immigration lawyer two years ago what was required, and he said; Proof of income is the primary basis, and it is highly preferred over assets!!
You are in a bad situation!!! I would bet,, that you stand a high chance of being audited !! Be ready to bend over and say ouch!!!
If you start to file tax returns now, you will be three years away from being eligible! Perhaps you could come up with a good explanation for not filing,,, but I doubt it could work!

Ralph, thanks for your input, but this is very disappointing news for me. I see on the I-134 form I can put down my employer, but will they check the records to see if I worked there? I am not on my parents pay roll/taxes or anything since I am paid under the table. And what about a co-sponsor? Also, what if she comes here on a visitor visa or work and travel and we marry when she gets here. Or what if I marry her in Russia? Any input would help, thank you!!
Ok so having a co-sponser seems like the best option for me. I think I can have my dad do it. What is required from him? What forms must he fill out? The forms he fills out, can they be copies or must they be originals? Must he be interviewed too? Thank you!!

First: You are in violation of the US tax filing requirements. You NEED to file tax returns for the income you make. You CAN file for previous years to make amends....ask Al Capone how it went for him when they found out he didn't file tax returns!
Second: You DO NOT need three years worth of income.....it is recommended to send in the past three years worth of tax returns....but many young folks who were students don't have prior income and can explain the lack of sufficient income. They do want you to prove your present income though.
Third: On the VJ website and on the USCIS website, you can determine the min poverty level for your potential new household size....if you can't show income at that min level.....all is not lost....you can use a cosponsor....like your mom or dad. They can cosponsor you....to do this both you and they will send in a I-134 form. Also note that this form is not required until the interview which is running about 5-7 months after the 129f petition and other forms are sent in. So this should not be a showstopper, just yet. And, IF she can get a visitor visa, then great but if you both intend to marry here by her using the visitor visa, that is visa fraud and if found out (maybe at the AOS interview) she may incur a lifetime ban and be deported. Some folks have successfully done it this way but it is circumventing the rules.
Marrying in Russia is fine but you would then file for a CR-1 visa for your new spouse and these presently are running longer than the K-1.

BigD, i am trying to get my head around the idea of your age and you wanting to go through all this to marry a russian.
i can totally understand why you earn as you do but this adds a big headache to this.
then worse is the pressure you may put on your parents to sponsor, if things go wrong..
at 21 i just never dreamed of marriage or the thought of a foreigner to be a wife.

all i'm getting at, there must be some other way to get yourselves together then this old school crap of marriage.
dude look at other options that keeps a little bit of your freedom with less paperwork and signatures by you.
look into work, student, tourist visa's and such for her.
this type of carry on is slow and maybe painful at times but will show her better or worse character before you think of the other.
spend physical time together under different circumstances before you think like you are.
you have all the time in the world.
and marriage actually doesn't mean shes yours till death do ya part.

You are in an unusual situation not having filed your income taxes! If you do have a family member act as a supporter, you are involving them into your troubles.
Some people have done this alone, without the help of an immigration lawyer,,,,, you should not be one of them!!!!!
Agents working for the former INS are over worked, most likely hate their job, and are encouraged to turn people down! You,, in your situation, will be easy pickens for them. And if you involve your father, he might be asked why he hasn’t been sending in your SS and state income taxes for you??

And finally, what Ralph said in his first post was correct!! You do not have enough time invested in this woman yet. Sure, being on skype every night is great, but you have not met yet! Even after meeting them, you still can’t be sure!! They are very convincing! The girl I wrote to the most, and met several times, is still the biggest mystery to me! I doubt very much whether I will ever truly know her!!!!
Yes LR, you did qualify you information with dates....but.....the income numbers you state, especially for present day requirements are incorrect.....AND....you make no mention about the household size...the income requirements differ depending on the household size....AND...they vary depending on the state he lives in.
Since we don't know all that basic info, just sending him to the appropriate link is best....that's why I stated misinformation because it could be misleading.
And, the three years worth of income statements is not a requirement but is suggested.
And if his case is typical, an attorney is definately not needed, unless you want to spend extra money and add some delays to the overall process....those two facts are certain.

I am sure BigD already knows he is in violation of the law by not filing his taxes. This is not necessarily trouble for him. A reason for not filing taxes is not making enough money. The minimum income requirement to file taxes is $9,375 for single, under 65. For self employed, $400.
He made no mention of children, so the household size would be two! My lawyer told me 16,000USD as of Jan of 2010! I myself, and whoever I choose to marry, won't have a child from a previous marriage!

If I report $20,000 of taxable income for 2011, will this suffice? Also, I was reading something about showing 3 years of "AGI". I don't know what this is, can anyone explain this to me please?
Just so you all know, I am going to see her in 3 weeks in December. I'm just looking into a K-1 Visa now because if all goes well with her, maybe in a year's time from now we can start the process for the paperwork (I know I must play early for this).

AGI,,, adjusted gross income? On the 2009 tax form, it was line 21! This is all of your income,,,, minus your tax deductable expenses,,, business expenses!
If I were you,,, I would wait awhile before planning marriage.

No,,, maybe not, you and your father, or who ever signs for her support might still need to answer questions about you not filing a tax return.

In 2011, in the lower 48, household size of 2 requires min $18,387
Back in 2006, the same would have been $16,500....wonder where the super attorney got their information? Most just muck it up for folks.

Yes if you have a co-sponsor then you and the co-sponsor(s) (can be one or more than one) can combine your incomes to satisfy the I-134 Affidavit of Supports
My suggestion to you is to think with your "big head" and date this girl for a couple of years... if she won't wait then she is not serious... don't rush into marriage at your young age! I dated my Ukrainian wife for three years and to tell you the truth I'm still finding out new things about her... life is great with her!
