Peter
Masha and Sergi are both Russian
Sergi has not permanent residency but was out here for nearly a year before applying to have Masha come out. Im picking after looking around he found his options none too flash and decided it best to call back home. Can you imagine the shock for a Russian guy to come out here and have to deal with NZ women. You almost feel sorry for them. Ive spoken to other Russian guys and they've said, "this is a great place, but the women....????"
Masha's application was based entirely on testimony, no hard evidence. She got letters from her parents, letters from his parents and letters from six friends saying they had seen them together????
Obviously it is much easier for them to build a case that way than we could.
Bob
not sure if you made me feel more confident or less ???
I think they (NZIS) would be more suspect on Sergi & Masha than my case, as you say - Sergi not have Citizenship.
Anyway - thanx for the info and please let me know anymore you gain (off forum)
Adman, an Australian should never marry a FSU women in her own country.
Its no longer a fiancee visa then..it becomes a Spouse Visa and take a hell of a lot longer to process AND THE CONDITIONS FOR A SPOUSE VISA ARE THAT YOU MUST HAVE LIVED WITH HER FOR 12 MONTHS OUTSIDE OF AUSTRALIA AND CONSUMATED THE MARRIAGE AND SHOW PROOF OF THAT BEFORE YOU CAN APPLY FOR A SPOUSE VISA AND IT CAN TAKE MORE THAN 12 MONTHS TO PROCESS.
How many men can afford to take 12 months of work and live outside of Australia in Russia etc....you marry her in her own country and you are screwed.
The only way is with a Fiancee Visa which requires proof of a personal visit and meeting with her in her own country first before you can apply and you must have known her at least 6 months including the time spent in a personal visit before you can apply and prove the relationship and genuine intent to marry in Australia if she is granted a fiancee visa..its very hard to get one for an FSU girl now and over 85% of applications are rejected at our Moscow Embassy and forget Tourist or Visitors Visas here..she will never get one.
The $33,000 minimum income is required for you to be able to sponsor her to Australia and qualify to sign an "Assurance of Support" which is a contract and gaurantee between you and the Government that you will financially support her for 2 years in Australia and if she leaves you during that time and the Government pays her Social Welfare payments..you as the assurer will have to pay it back and if you say no, the Government will only seize and sell your assets to get the money and they are as vigorous and forceful in this as the Taxation Department when they are owed money..you don't stand a chance.
If you have not made the minimum income of $33,000 before tax(gross taxable amount) over the last 2 financial years you can not sponsor her here as you can not sign an "Assurance of Support" and have to find another adult family member or friend who qualifies on the income to do it and who in the hell would want to take that risk with an FSU bride..most Australians will say no and not stick there necks out for anyone else considering the negative perception of them here as scammers..the 60 minutes story that aired on National T.V in 2003 and called "Russian Roulette" featuring immigration scams and internet scams by these FSU people done a lot of harm down in the land down under. and most people here view all of them as scammer mail order brides.
These laws came in at the end of 1998.
I did my fiance visa in 1989 and there was no such laws then.
Its very much changed and a lot more difficult and there is a clamp down on all FSU girls wanting to come here due to the wide spread scamming happenning.
Some extra info...minimum time to process a Fiance Visa for and Australian Citizen or Resident to marry a FSU girl..7 months..thats the Moscow embassy's standard of service and all our embassies are trying to improve the processing time..spare a thought for some Aussie tring to get a girl from Africa..I think Kenya, processing time is 104 weeks or 2 years!
A Spouse Visa is a horror of a thing...can take more than 12 months to process..the Fiance Visa is done in about half the time.
Anyway its impossible to for an Australian to marry a Ukrainian woman..theres a minimum stay requirement in Ukraine of 30 days before you can apply to ZAGS for a marriage application and another 30 days notice required before the ceremony can be done in the ZAGS office (ZAGS is the Ukrainian or Russian marriage registry office and you must officially marry in the office as church or civil ceremonies are not recognised).
Before you can go to ZAGS, you must have a "Certificate of non-impediment to Marriage" if youh ave been amrried before as they will not accept an Australian divorce certificate as evidence of a divorce. This entails you going to the Department of Foreign Affairs in Australia, getting the forms done, presenting the evidence that you are divorced and this then gets sent to our Moscow Embassy where it is translated and certified as a legal document before it comes back to you before you even consider going overseas to see your girl.
It takes about 2 months to do this and it costs about $60.
But thats not the end of it..its still not a legal document until it is taken to the Government office in Ukraine or wherever and "legally notarised and validated by authorities there" and this takes a long time as well as money..often it is necessary to pay bribes to officials there to get things moving.
Then you can go to ZAGS and try and marry her but if the slightest thing wrong with the paperwork, the marriage will not be recognised or nor even perfomed!
FORGET ABOUT MARRYING HER IN HER OWN COUNTRY..ITS A DISASTER..DON'T DO IT!
Its impossible to marry a Ukraine or Russian girl in her own country because of that countries bureaucracy, bull-shit and corruption and did you hear recently,Ukraines President, Viktor Yushenchko sacked his Prime Minister (Yulia Tymoneshko) and parliament for corruption.
Corrution and bribery is rife in these FSU countries and they will see a Western guy coming as soon as he hops on a plane and try and nick him for money as soon as he lands on Russian soil..I have read so many stories about this!
After reading all that Aussi - I will stop my moaning - NZ not so bad. They processed 2512 Visas in timeframes between 1/07/2004 to 30/06/2005 and the acceptance was 87%. The majority of temporary visas can be processed in less than 14 working days.
We (NZ) have no Fiancée Visa now. They are judging and issuing 9 month visitor Visa based on proof of genuine intention and pending success of that relationship.
Difficult to accept that our (my fiancé and I ) future lies in the hand of 1 person sitting at a desk in Moscow. Who doesn’t know us !!!!!!!
Thanks Aussi for the post
Especially the part about marrying a girl in Ukraine.
I had read the process before and thought it complicated but assumed it couldn't be that difficult and people just would work there way through it. You do put it in perspective and thats great. Hard to understand the attitude from immigration at this end.
Peter, I owe you an apology
Getting married in Ukraine doesn't sound like a smart idea.
You must prove that you lived together as husband and wife and showed financial dependance such as sharing the bills, place of residence etc.
This must be for 12 month period before you can apply for a Spouse Visa for Australia.I don't think DIMA accept cum stains on the sheets as evidence..ha ha ha!
Seriously DO NOT GET MARRIED IN HER COUNTRY FOR AUSTRALIANS, YANKIES ETC.
Many Western countries will also not legally recognise this marriage and also if something goes wrong in the future it will be difficult and costly to get a divorce if you married an FSU gal out of your country.
Marrying her in her country will not guarantee the issue of a spouse visa..if she fails health and criminal record checks, she will not get the visa and the fact you married her does not matter and if you want to live with her, in that case you will have to immigrate to her country for good!

After two weeks of confusion and complaints, Moscow's visa and passport department has reversed itself and resumed stamping residency permits in the passports of travelers holding multi-entry commercial visas, visa agencies and business lobbyists said.
The new rule would have required frequent business travelers to reregister every time they entered the country.
