Marriage for a green card only costs $10,000? I heard as much as $20,000. My last offer a few months ago was $5,000. She didn't have much money. I think she was prepared to pay for it by other means. It was a third party that offered me. I never did see the lady.
It must be difficult for a visitor to prove that her marriage is real, if it is. My first marriage was to a visitor. The immigration officer was about to give me a hard time when I pointed to my wife who had a toddler with her.

So, my fiance and I met in the summer when I was on a J-1 working. We dated until I had to go back because I had to finish college. So we did long-distance that winter and we did know I was coming back on a J-1 again. I thought about a K-1 back then but we didn't know each that well so we thought we'd rent together and I'd be able to work as well (J-1 allows you to work) and then we'd just get married and have my status adjusted. So when I was coming back after graduation we were already speaking about marriage... Idk if it was a fraud then to enter on J-1 having those thoughts...
Anyways when I came in things changed. Living together is definitely different from dating and after not having seen each other for 8 months too it was back to getting adjusted to each other. And my fiance had difficulties at work so we always had something up that didn't allow us to plan a wedding. We were pretty much on our own with our plans, a few thousand dollars total and me adjusting to a new country. But we did buy a marriage license and rings.
Whatever happened next happened and now I'm here.
I guess you're right, we shouldn't be disclosing those facts our relationship but it's going to be hard because I have a history of living in the States and he's 23 which means Zero money.
And he doesn't understand a think about how K-1 works so I have to look into it for him.

nerd, It's OK to disclose your relationship -- in fact, it is quite necessary! And it's OK to tell them that you decided while you were in the US that the two of you wanted to marry, and bought rings etc.
I would simply omit the part, about having intended to marry IN the US, under your J-1 visa. This wouldn't help the K-1 process anyway (it is enough that you are engaged!), and might risk raising suspicion in the minds of the immigration officials.
So leave out the marriage license and the date/place of marriage you originally had in mind, but tell them about your relationship, commitment to marry, living together, etc. etc. This is what they need to see, in order to establish that you will make a genuine marriage -- not one "arranged" strictly for migration purposes.
As far as I can see, the two of you should do fine. It takes a lot of time, an amount of paperwork that is stunning to most Americans (канцелярщин 1072; как в Российской Федерации ;) ), and unfortunately (according to some of the guys here who have done it) quite a few hundred dollars in various fees. But I expect that you will be married and living in the US sometime in 2010...
You can work under a K1 visa also. Nothing stops one from getting a social security card or a waiver to work under a K1. As long as your within the 90 days of your I-94 you can apply for a social security card. Also at 30k a year he is above the 125% of the poverty level so the money shouldn't be an issue. So a sponsor shouldn't be needed.
I don't understand why many think the visa process is so difficult? I've never used a lawyer for anything including the conditional green card and lifting of conditions. It's not that difficult and a waste of money to have an attorney do it. Unless you have some extenuating circumstance in your history
the devil's advocate here. how old is this gentleman? do you feel he is in a position and completely committed to the fact that this is forever? frequently marriages of people of that age tend to fade in less than ten years when one or the other - usually the woman - realizes there is not a maturity in the relationship. and that you are more forward in the desire to discover information regarding the processes and legal aspects - I believe you mention something of his stubborness - I think you should question just that. however, it may be a real desire and mutually committed. just thought I would throw that out there. I find it interesting that at first, many questioned your real origin. then after a debate it was determined that yes, you are a twenty-three year old young lady. then it seems men are falling at you feet to help you. this says nothing about you, but of the men here on this forum. if it was a twenty-three year old male from the US asking such questions I think he would have been buried. just my past observations that I tend to think this way.
the embassy will require a lot of proof that you will not be regarded as a risk to become dependant on the state for support. in other words, there must be proof of a serious relationship AND that this guy is financially able to support you. and that this support must be proven beyond reason.
I know now how intrusive the process is. and that I must provide quite a lot of documentation of my ability to MORE than provide for someone. something to think about and discuss with your american friend.
Also if the marriage does fail, the male is financially liable for the woman for ten years, unless she remarries, so any public charge and assistance she may recieve will be charged back to the man.
Julian sometimes I think you guys go way over the top on this k1 visa. It's not all that difficult. The only guidelines on financial support is 125% above the poverty level depending on the number in the family. Yes having a strong financial background doesn't hurt.

It's complicated that's why I went back. He's 23 and when I met him he was trouble.
We've had bad times and good times. But I liked him for being the first guy of my age (dated a very respectable american 13 years older than me for a while being literally obsessed with him just to get to know that all all our it was just a summer fling and just 'a trip to europe') who didn't bullshit me, who told the truth on day 1 and stayed that way and who faithfully waited for me for 8 months in the sweetest way making me feel good about us. He has a lot of potential as a person and as a man and if some of the issues of his are finally out of the picture, he'll be the kind of guy girls would fight for ) And he's never on line trying to date, never did that. lol So I know he's not out there looking, he's not a ladies man even though he's very handsome and he could be one of those cocky guys changing girls like weather.
Idk if he's going to go through with the whole K1 thing and if I get approved. Time will tell. He'll learn if it's important.
I just hope to believe it's right, I may be mistaken as well as I may be right. But as any Russian chick who hasn't seen much and been through lots of crap, I want to believe the better.
Oh my guy's got almost Zero money and he needs a new car so I really don't know how that will work and what I'm thinking but at this point of time I'm learning to be independent and learn from my american girlfriends who earn it themselves and live nice lives not depending on anyone even their husbands. Maybe it's better that way.
You live and learn, definitely. We all wish to be those girls from Orange County living in those houses with an ocean view and shopping at Gucci or whatever but we're here and we have to work our way up the way we can so it's cool for many Russian girls to learn to rely on themselves and not expect much from a guy. You don't get that guaranteed on age or marital status or your bank statement or your car make.
Nas you are wrong. There is no "waiver" for working under a K-1. Yes you can obtain a SSN but it will be marked, "No work unless with a USCIS authorization", or something to that effect. The only legal way a K-1 person can work with with the EAD which can be applied for free along with the AOS (Green Card) petition.
Excuse me baron, I didn't use the correct terminology, EAD. It is still unclear whether they can or cannot work with just the K1 many have and it's a disputed fact under Homeland Security, just a receiving a two year or ten year green card. Getting the USCIS authoriztion isn't that difficult either. Nothing like no work was one my wifes green card, I urge you do your homework.

point is as you describe -- a public charge. A little mouse told me that not providing the required documents as requested by the consulate in question could mean a big delay in getting the final approval. or total denial. within reason there must be disclosure of the fact that the woman will not become a 'public charge'. that being said, there is no way to prove you are just above the poverty level by withholding information. shit I pay taxes that are above the poverty level. it was just stated that I must "prove" my income etc. and the documents required "prove" it beyond reason.

People who enter with a K-1 can not work until they get their EAD or their GC. Maybe you and yours came much earlier when thing were different. I speak from how it is now.

EAD is necessary-- there is a fee to apply for it unless you do it all at the same time. Or the individual working under green card status is working illegally. Of coarse if yoou don't have a green card and work is a different story. Then you are from the south of america. And Obama will grant you anything you want.
I actually meant to say that I chose my fiance out of all other guys not for money or his citizenship for who he is a person. I offered him to move to Russia many times because my family in Russia has means to probably help us live better than we'll be living in the States but he said No and that's why we're doing K-1.

Nothing on the Social Security Card said she could not work when she received it and it was done with only an I-94. There was no conditional green card of recipt of SS. Is that clear enough. The documents used now to attain a K1 visa are no different than the ones I used. Information is the same. Only difference now is IMBRA laws.
Julian if you have a green card you don't need an EAD. Also the I-765 (EAD) can be applied for
at some points entry, I know JFK and O'Hare you could apply. We entered at O'Hare. Maybe now not. Our entry, which I had heard of horror storys took 5 minutes in Chicago. She handed over her documents, security looked at them and welcomed her to America. Each point of entry is different, each branch of the USCIS is different, Each Embassy is different, processing centers are different, 2 year green cards get issued and 10 year cards be issued on the first AOS. Some are required interviews for AOS we never had an interview since Kiev. Nothing and I mean nothing is etched in stone.
Nas, actually employers should not just accept a SSN or card as authorization to work. That is illegal. I think there is an I-9 form or something that they are supposed to look for. So if one was issued a SSN without the Can Only Work with USCIS Authorization stamp on it, that is not enough.
JFK used to issue EAD stamps, but they too were useless; JFK stopped this in 2007. And yes the GC allows one to work. The EAD, like the AP, can be applied for free when filed with the AOS and are usually a couple or months earlier to obtain. The AP allows one to leave the country and get back in.
