The 9th and 10th amendments guarantee this to the states. Same as Roe V. Wade, no where is this a Federal Issue, this is a states rights issue, but no one has the balls to overturn it, or congress which also has the final say in what the supreme court can rule on. It's been a ploy to take power away from the people and centralize it. The key word here is "probably". Don't make a point with that word until it is done. When did the Supreme Court ever make a decision without constitutional reason? The American system is not perfect, but it is a rule by the people. Have an issue loud enough, often enough by a majority and you will be heard.
